Children Under the Age of 18

We collect information from and about users of our App or Website:

Information You Provide to Us

When you download, register with, or use this App and Website, we may ask you provide information:

 

•      By which you may be personally identified, such as name, postal address, email address, telephone number, social media login information, or any other identifier by which you may be contacted online or offline (“ personal information”).

•      That is about you but individually does not identify you, such as your feedback information, comments, reviews, etc.

This includes information provided at the time of registering to use the App or Website, subscribing to our service, posting material, favoriting items and requesting further services. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem or provide feedback.

•      Your responses to surveys that we might ask you to complete for research purposes.

•      Details of transactions you carry out through the App or Website and of the fulfillment of your orders. You may be required to provide financial information before placing an order through the App or Website.

•      Your search queries on the App and Website.

You may also provide information for publication or display (“ Posted”) on public areas of websites you access through the App or Website (collectively, “ User Contributions”). Your User Contributions are Posted and transmitted to others at your own risk. Please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of third parties with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

 

Automatic Information Collection and Tracking

When you download, access, and use the App or Website, it may use technology to automatically collect:

•       Usage Details. When you access and use the App or Website, we may automatically collect certain details of your access to and use of the App or Website, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the App or Website.

•       Device Information. We may collect information about your mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information, and the device’s telephone number.

•       Stored Information and Files. The App or Website also may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.

•       Location Information. This App or Website collects real-time information about the location of your device. The App and Website collects your location information to better serve your needs.

If you do not want us to collect this information you may opt out at any time by choosing to do so through your phone’s location sharing settings. Note, however, that opting out of the App’s collection of location information will cause its location-based features to be disabled.

 

We also may use these technologies to collect information about your activities over time and across third-party websites, apps, or other online services (behavioral tracking).

Some third-party browsers have a "do not track" feature that lets you tell websites that you do not want to have your online activities tracked. The usage information we collect helps us to improve our App or Website and to deliver a better and more personalized experience by enabling us to:

•      To third parties to market their products or services to you if you have not opted out of these disclosures. We contractually require these third parties to keep personal information confidential and use it only for the purposes for which we disclose it to them.

•      To fulfill the purpose for which you provide it. For example, if you give us an email address to use the “email a friend” feature of our Website or App, we will transmit the contents of that email and your email address to the recipients. Or, if you give us a postal address to deliver flowers or goods to, we will transmit that information to the necessary party that will carry out that delivery.

•      We share your personal information with our marketing and sales partners, who help us manage our advertising, and enable us to send you information about our products and services you may be interested in. What is our legal basis for using your personal information?

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. Accessing and Correcting Your Personal Information

You can review and change your personal information by logging into the App or Website and visiting your account profile page.

 

You may also send us an email at info@frenchflorist.com to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

 

If you delete your User Contributions from the App or Website, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other App or Website users. Proper access and use of information provided on the App, or Website, including User Contributions, is governed by our Terms of Use.

Data Security

All information you provide to us, excluding payment information or social media logins, is stored on our secure servers behind firewalls and encrypted using SSL technology. Information for any payment transactions, such as credit or debit card information, is processed through our third-party payment processor Braintree by Paypal, and the use of your payment or personal information for payment processing is governed by Braintree’s Privacy Policy and practices.

 

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our App or Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the App or Website like message boards. The information you share in public areas may be viewed by any user of the App or Website.

 

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our App or Website. Deletion Request Rights

 

You have the right to request that French Florist delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

 

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

 

•      Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.

•      Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

•      Debug products to identify and repair errors that impair existing intended functionality.

•      Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

•      Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).

•      Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.

•      Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

•      Comply with a legal obligation.

•      Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

 

Exercising Access, Data Portability, and Deletion Rights

 

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

•      Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

 

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

•      Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.

•      Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

 

Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account.

 

We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

For Facebook users who login using Facebook

We will keep your Personal Data for as long as you use the App. In the event that you do not use the App for a period of 365 days, the system will automatically delete your account and all of your data. We do not keep your data for any longer than is necessary in accordance with applicable law. User can delete his account in our application from User profile -> before log out -> Delete Account

Response Timing and Format

 

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

 

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

 

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

 

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.‌

 

Personal Information Sales Opt-Out and Opt-In Rights

 

If you are 16 years of age or older, you have the right to direct us to not sell your personal information at any time (the “right to opt-out”). We do not sell the personal information of consumers we actually know are less than 16 years of age, unless we receive affirmative authorization (the “right to opt-in”) from either the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age. Consumers who opt-in to personal information sales may opt-out of future sales at any time.

 

To exercise the right to opt-out, you (or your authorized representative) may submit a request to us by emailing a request to info@frenchflorist.com with the subject line “Do Not Sell My Personal Information”.

 

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back in to personal information sales at any time by emailing info@frenchflorist.com with the subject line “Opt-In Instructions”.

 

You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request. ‌

 

Non-Discrimination

 

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

 

•      Deny you goods or services.

•      Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.

•      Provide you a different level or quality of goods or services.

•      Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

 

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

 

Other California Privacy Rights

 

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
